WAUSEON CITY COUNCIL MEETING
Monday, May 4, 2009 at 5:00 P.M.
This meeting of the Wauseon City Council was called to order at 5:00 p.m. by Mayor Dehnbostel. Following the Pledge of Allegiance and moment of silence, roll was called by the Clerk of Council. Present were Councilor President Shaw, Council Mathews, Chamberlin, Huner, Krumm and Stiriz to constitute a quorum for the transaction of City business.
APPROVAL OF PRIOR MEETINGS’ MINUTES
Councilor Mathews made a motion and seconded by Councilor Stiriz to approve the previous meetings’ minutes.

Annual Joint Meeting Between City Council and Clinton Township Trustees
This is the annual joint meeting of the Wauseon City Council and the Clinton Township Trustees to elect a board member to the Wauseon Union Cemetery.
Roll was taken by the Clerk of Council. Present were Council Members Shaw, Mathews, Stiriz, Chamberlin, Huner and Krumm; Clinton Township Trustees Hite and Richer. Clinton Township Neuenschwander was absent.
Councilor Huner made a motion and seconded by Clinton Township Trustee Richer to reappoint Robert Krumm to the Wauseon Union Cemetery Board for the term January 2, 2010 to January 1, 2013.

Clinton Township Trustee Richer made a motion and seconded by Councilor Krumm to adjourn this annual joint meeting.

INDIVIDUALS WISHING TO ADDRESS COUNCIL AND TOPIC
Justo Suarez – Excessive Sound Amplification
Mr. Suarez said that there is an individual that drives by his home and the sound amplification system is heard outside his vehicle. The music is so loud he can hear it four blocks away. This is very disturbing to him and his neighbors. He approached the individual but he refused to turn his music down. He referred to Section 337.30 of the code which states that this is a violation. Is this ordinance going to be enforced? He has reported this to the Police Department but this person has not yet been apprehended for this offense. He is tired of this continuing and that this individual has not been charged with noise disturbance.
Chief Torbet said this is the first he has heard about this. Mr. Suarez should call the Police Department and they can cite him. If we see him and there is a violation we will cite him for this.
Councilor Mathews said that these individuals are aware when there is a police car in the vicinity and they will turn down their music.
Mr. Suarez said he will call the Police Department.
Committee Reports
Safety and Code Committee
Councilor Chamberlin reported on the Safety and Code Committee meeting of April 20, 2009. They committee continued their discussion on the use of City vehicles. Councilor Chamber reported on what the savings would be. The committee made the recommendation that the City may provide employees with a City owned vehicle for purposes of commuting to and from work from their place of residence provided their place of residence is within five miles of the corporation limits.
Councilor Chamberlin made a motion and seconded by Councilor Huner to approve the committee’s recommendation.
Councilor Chamberlin said he would like to make additional remarks regarding the recommendation of the Safety and Code Committee. He read out loud from a prepared statement of why this would be a savings to the City. He had researched and calculated the estimated gas dollars and wear and tear on the vehicle. He also said the liability exposure the City assumes in the event of an accident while the employee commutes to his home. He does not feel we have to follow suit with other governmental agencies. Councilor Chamberlin referred to comments made at the previous Committee of the Whole meeting that the amount of savings was not significant and if it is not broken don’t fix it. He then referred to many budget reductions the City made since the beginning of the year and that council’s legislative approach should be proactive rather than reactive. Councilor Chamberlin said that the reason for making this recommendation is to save the City some dollars.
Councilor Krumm said that she looks at this matter in a different perspective and recognizes the savings on mileage, but years ago under a different administration the use of those vehicles was granted and has become an accepted part of the compensation plan. At the point where we start cutting compensation as a cost saving measure for the city, then that is something we should look at. At this point it is cutting compensation for two individuals.
The value of that privilege is recorded on their W-2 forms.
Mayor Dehnbostel said he surveyed some other Northwest Ohio communities much smaller than Wauseon and found out that the compensation of the Administrator, similar to the Public Service Director, the average of those nine other communities’ compensation was $3,500 more a year than the Public Service Director’s compensation.
Council had additional discussion about this with the different perspectives regarding this.

Department Head Reports
Steve Brown, Regional Planning Director
Mr. Brown reported that the Sarah’s Garden loan is ready to go forward. We will be receiving the technical specifications for the Maple St. sidewalk project through the Block Grant program.
Marv Wheeler, Fire Chief
Chief Wheeler said we will be having the RIT class the next two weeks. Twenty-two firefighters in the area will be coming to that.
Keith Torbet, Police Chief
Chief Torbet explained the grants that will be presented under New Business. We are working on donations for Safety City this year. We already have kids registered this year. He worked last weekend with Partnerships for Success, for "Parents Who Host Lose the Most". We had five additional officers out on prom night. He wanted to compliment Circle K on their assistance in that they ID’d every single person who bought alcohol.
Dennis Richardson, Director of Public Service
Mr. Richardson said we have bid openings for the "chemical tank for the Water Reclamation Plant" and the "re-build the tennis courts". Gerken Paving was the low bidder on the tennis courts and it was below our estimate. The chemical tank bidder was $8,000 over estimate. Overall, we had a significant savings.
Mr. Richardson said last week the Mayor and he had met with a fiberoptic company that was looking for a parcel in the Wauseon area situated next to the N&S Railroad. They were looking for a place for their booster station. Mr. Richardson passed out a copy of a quit claim deed of City property on the south side of Elm St. where we have the Toledo Edison line extension going up to IAC. There were also some storm sewer improvements on that parcel.
To allow this, a motion would be needed to allow the Mayor to negotiate a lease for this parcel to the company’s name we don’t know yet. They are looking for a 25 year lease. This motion will be under "New Business."
Mr. Richardson gave an update on the EQ basin project and improvements to the Water Reclamation plant. He said the City did not make the Ohio EPA’s list of those who will be receiving the federal stimulus monies. We are not on that list right now but we are still hoping to be in a position to be considered.
Mr. Richardson asked for a Building and Grounds Committee to discuss the aeration pumps for the pond at Wauseon Machine, Plant III.
Jon Schamp, Director of Finance
Mr. Schamp reported on the gross revenue receipts for year to date. Mr. Schamp distributed the financial reports for April, 2009.
Steve Buehrer, Director of Law
Mr. Buehrer said the department is working on a number of administrative projects but nothing to report at this time.

The Supplemental Fiscal Officer’s Certificate pertaining to the issuance of the notes was presented to Council prior to consideration of Ordinance 2009-4.
Ordinance 2009-4 - Providing for the Issuance and Sale of $3,100,000 of Notes in Anticipation of the Issuance of Bonds, to Pay Costs of Improving Certain Streets in the City, and Declaring an Emergency
Councilor Stiriz made a motion and seconded by Council President Shaw to suspend the rules and declare an emergency on Ordinance 2009-4.

Councilor Krumm made a motion and seconded by Councilor Mathews to suspend the rules requiring three readings and declare an emergency on Resolution 2009-11.

MONTHLY REPORTS
The month-to-date bank report, month-to-date fund report, month-to-date revenue report for April, 2009 and YTD Gross Income Tax Receipts reports was distributed to council
Negotiate Lease for Booster Station for Underground Fiberoptics
Motion made by Councilor Krumm and seconded by Councilor Huner to authorize the Mayor to negotiate a 25 year lease for City property adjacent to the N&S railroad. (SW ¼ of Section 23)

Concrete Work around Concession Stand at Dorothy Biddle Park
Mayor Dehnbostel said when the concession stand was built 8 or 9 years ago, the concrete work around it was never finished. In order to comply with final state approvals, completion of this is required.
Motion made by Council President Shaw and seconded by Councilor Krumm to reallocate $16,000 from the Capital Income Tax account entitled Unallocated Capital (403.569.52500) to the Capital Income Tax account entitled Parks Equipment (403.302.52500).

Authorization to Apply for Grants
Councilor Mathews made a motion and seconded by Councilor Stirizto authorize the Mayor or his designee to make applications for the

and authorize the Mayor or his designee to execute any and all documents necessary to participate in the grant programs.

There being no further business to come before this session of the Wauseon City Council, Mayor Dehnbostel asked for a motion to adjourn. Councilor Krumm made a motion and seconded by Councilor Huner to adjourn this meeting at 5:50 p.m.
