WAUSEON CITY COUNCIL MEETING
Monday, June 1, 2009 at 5:00 P.M.
 
This meeting of the Wauseon City Council was called to order at 5:00 p.m. by Mayor Dehnbostel.  Following the Pledge of Allegiance and moment of silence, roll was called by the Clerk of Council.  Present were Councilor President Shaw, Councilors Chamberlin, Huner, Krumm, Stiriz and Mathews to constitute a quorum for the transaction of City business.
APPROVAL OF PRIOR MEETINGS’ MINUTES
Councilor Chamberlin made a motion and seconded by Councilor Huner to approve the previous meetings’ minutes.

Mayor Dehnbostel
Mayor Dehnbostel said that he would like to bring everyone up to date on some of the things that have happened in town over the last week. There was the dedication at Dorothy Biddle Park. It was a great turnout with over 2,000 people in attendance. We also had the grand opening of HP2g, an engine manufacturer. Grieser Interiors plans to open this month and Aaron Rents furniture store has their site ready to build. Lot of good positives going on right now.
Committee Reports
Safety and Code
Councilor Chamberlin reported on the committee meeting held on May 28, 2009. The committee discussed the penalty for the possession of marijuana. Lieut. O’Brien brought the issue to our committee about increasing the penalty from a minor misdemeanor to an M-4. After review and discussion by the committee, the committee recommended changing the penalty to an M-4.
The committee also had received a complaint about truck traffic on Chestnut St. We talked about that and that there may be truck traffic occasionally on Chestnut St. to Chestnut Ct., but the committee did not take any action on this.
The committee received a request from Councilor Krumm to consider "reduced speed limit signs" on St. Rt. 108 coming from the south into town. Lieut. O’Brien said he will refer this to Chief Torbet.
Motion made by Councilor Mathews and seconded by Councilor Stiriz to accept the Safety and Code’s recommendation: increase the penalty for the possession of marijuana for amounts up to 100 grams from a minor misdemeanor to a misdemeanor of the fourth degree

Ordinance 2009-4 – Amending Section 929.21(e) of the Codified Ordinances of the City of Wauseon
Councilor Stiriz made a motion and seconded by Councilor Huner to place Ordinance 2009-4 on first reading and that the first reading be passed.
Vote: 6 Yeas – 0 Nays First Reading Passes
Advertise for Bids – Franklin/Walnut St. CSO
Resolution 2009-17 - Authorizing the Mayor to Advertise for Bids for Materials for and Construction of CSO Eliminator-Franklin/Walnut Streets; Authorizing the Mayor to Accept the Lowest and Best Bid; Authorizing the Mayor to Enter into a Contract with the Lowest and Best Bidder; and Declaring an Emergency
Councilor Stiriz made a motion and seconded by Councilor Chamberlin to suspend the rules requiring three readings and declare an emergency on Resolution 2009-17.
Vote: 6 Yeas – 0 Nays Motion Carries
Councilor Huner made a motion and seconded by Councilor Krumm to place Resolution 2009-17 on final passage whereas an emergency was declared.
Vote: 6 Yeas – 0 Nays Resolution 2009-17 Passes and is in Effect

Resolution 2009-15 – Authorizing the Mayor to Assign and Transfer Lear Corporation’s Rights, Duties, and Obligations Contained in the Ohio Enterprise Zone Agreement between the City and Lear Corporation to IAC Wauseon, LLC
Councilor Huner made a motion and seconded by Councilor Mathews to place Resolution 2009-15 on second reading and that the second reading be passed.

THIRD READING OF LEGISLATION

Acceptance of Grant Procedure
Resolution 2009-13
– Authorizing the Mayor or his Designee to Make Application for Grant Programs, and to Accept Grant Awards Upon Motion of Council
Council President Shaw made a motion and seconded by Councilor Krumm to place Resolution 2009-13 on third reading and that the third reading be passed.

APPROVAL OF BILLS
Motion made by Councilor Huner and seconded by Councilor Stiriz to approve and pay the bills as presented

Councilor Huner was excused from this meeting at 5:10 p.m.

Department Head Reports
Marv Wheeler, Fire Chief
Chief Wheeler said the fireworks went well at Dorothy Biddle Park for the dedication ceremony. Chief Wheeler reported on the fire department equipment that was repaired and now done and work they will be doing on the hydrants.
Keith Torbet, Police Chief
Chief Torbet said regarding the Safety and Code committee’s report, Lieut. O’Brien did get a hold of him and we are checking on the "reduced speed limit" signs. We need to check first with state first to get their approval since it is a state route. The county doesn’t mind if we put up a sign as long as we take care of it. We have a new car in the department and on the road. We will first try and sell it on Gov.deals to another law enforcement agency; otherwise we will strip it down and sell it that way.
Chief Torbet said that Woman and Family Services closed their offices which caused us to lose our victim advocate. We have entered into a tentative agreement with the Center for Family and Child Advocacy in Napoleon to handle our advocacy.
Dennis Richardson, Director of Public Service
Mr. Richardson said James Crawford, Public Works Department, passed his Class II sewer collection license test. Two other employees who took the same test are awaiting their results. Mr. Richardson gave an update on the project for the improvements at the Water Reclamation Plant, the equalization basin and sludge storage. Mr. Richardson said that the Ohio EPA is coming out with a revised list of scores for community projects for the stimulus package funding. There may be changes in project status so we are waiting to hear of any favorable changes on our behalf.
Councilor Chamberlin inquired about the status regarding amending the code on sewer connections. Mr. Richardson said that the law department had prepared some language on this and gave it to his office.
Councilor Chamberlin inquired about the painting of the crosswalks. Mr. Richardson said Dave Murry has ordered the paint.
Jon Schamp, Director of Finance
Mr. Schamp said he distributed the May financial statements. He gave an update on the year to date figures. Mr. Schamp said that Arcadis has prepared a rate study He would like to schedule a time for Arcadis to meet with the Utility Committee to go over our current water and sewer rates.
Stephen Buehrer, Director of Law
Mr. Buehrer said that there are a lot of projects going on and they are working with some of the departments on certain requests.
Councilor Mathews inquired about the "Click it or Ticket" program. Chief Torbet said that the program went very well.

The month-to-date bank report, month-to-date fund report, month-to-date revenue report for May 2009, and YTD Gross Income Tax Receipts report
was distributed to council

There being no further business to come before this session of the Wauseon City Council, Mayor Dehnbostel asked for a motion to adjourn. Councilor Mathews made a motion and seconded by Councilor Krumm to adjourn this meeting at 5:20 p.m.
